These terms govern the TapeRank affiliate program and are an agreement between you (the "Affiliate", "you") and Gravy Brands LLC ("TapeRank", "we", "us"). By applying to or taking part in the program you agree to them, and to the terms of service, which continue to apply to your own use of the Service.
Two sections carry obligations that we will enforce by removing you from the program: disclosure, and what you may not say. Read those two even if you read nothing else. They exist because TapeRank is a market-screening tool used by people risking their own money, and because the law holds us responsible for how our affiliates describe it.
1. Joining
You apply through our affiliate platform, PromoteKit. We approve or decline applications at our discretion and do not have to give a reason. You must be at least 18 and able to form a binding contract, and you must give accurate account and tax details and keep them current. One person or business, one affiliate account.
2. What you earn
- Rate. 30% of the net amount we actually receive on each qualifying payment from a customer you referred.
- Duration. The first 12 months of that customer's subscription, counted from its first payment. After that the subscription earns nothing further, whether or not it continues.
- "Net amount" means what reaches us after discounts, coupons, taxes, refunds, chargebacks and payment-processing fees. Our price is tax-inclusive, so tax is carved out of it before the commission is calculated.
- A discount reduces the commission. Your promotion code gives the customer 20% off for 3 months, so for those months we receive less and your 30% is 30% of the smaller figure. The rate does not change; the base does.
- Free plans and trials earn nothing. A commission arises on a payment, not on a sign-up. A trial that is canceled before it converts produces no payment and no commission.
Pro is USD $49 per month at the time of writing. We may change the price; see the pricing page for the current one. Your commission follows whatever is actually charged.
3. How a referral is attributed
- By link. Your link sets a cookie in the visitor's browser that lasts 60 days. If they subscribe within that window, the sale is yours.
- First click wins. If a visitor arrives through two affiliates' links, the first one is credited for the whole window. A later link does not overwrite it.
- By code. A customer who enters your promotion code at checkout is credited to you whether or not they ever clicked your link, and whether or not they hold a cookie.
- What breaks attribution. Cookies that the visitor blocks or clears, a different browser or device, or a purchase made after the window closes. We credit what our platform records, and that record is final absent manifest error.
4. Payment
Commissions are held for 30 days after the payment that earned them, so that refunds and chargebacks can settle. After the hold they become payable and are paid monthly through PromoteKit, subject to any minimum payout threshold and to the payout method shown in your affiliate dashboard. You are responsible for keeping valid payout details on file. We are not liable for a payment that fails because your details were wrong or out of date.
5. When a commission is reversed
We may cancel or claw back a commission that has been credited to you if:
- the customer is refunded, charges back, or their payment is reversed;
- the sale came from a breach of these terms, including a breach of section 6 or 7;
- the referral was fraudulent, self-dealing, or generated by automated means;
- the account was a duplicate, a test, or otherwise not a genuine customer.
You may not refer yourself. Using your own link or code for your own subscription, or for an account you control, earns nothing and may end your participation.
6. Disclosure you are required to make
Every post, page, video, email, message or story in which you promote TapeRank must disclose that you earn a commission. This is a legal requirement under the US Federal Trade Commission's Endorsement Guides, and it is a condition of taking part. The disclosure must be:
- Up front. At the beginning of the post, before any link, and visible without clicking "more", scrolling past the fold, or opening a thread.
- In the same medium. In a video, say it out loud and put it on screen; a line in the description alone is not enough. In an audio-only format, say it.
- In plain words. "#ad", "#affiliate", or a sentence anyone would understand. Not "#sp", not "#collab", not "#ambassador", not a link labeled "support me".
- Not buried. Not in your profile bio only, not in a block of unrelated hashtags, not in small grey text under the fold.
Wording you may copy:
#ad — I earn a commission if you subscribe to TapeRank through my link.
Affiliate disclosure: TapeRank pays me a commission on subscriptions from this link. It does not change what you pay.
You must not pay, or offer anything of value to, anyone else in exchange for a positive review or testimonial, and you must not write a review of TapeRank that presents you as an ordinary, unconnected customer.
7. What you may not say
TapeRank is a screening tool. It is not investment advice, it recommends nothing, it predicts nothing, and it routes no orders. Your promotion must not suggest otherwise. Specifically, you must not:
- make or imply any claim about profits, returns, income, win rates or account growth — not about your own results, not about anyone else's, not as a target, a range or an example;
- present TapeRank as investment, financial, legal or tax advice, as a recommendation to buy or sell any security, or as a source of trade signals or alerts to act on;
- show or describe hypothetical, simulated, backtested or cherry-picked results, whether yours or ours;
- guarantee any outcome, or describe the AI verdicts as accurate, verified, or a basis for a decision;
- suggest that TapeRank is a broker, an adviser, a signal service, or that it is regulated as any of those;
- state or imply that we endorse your own trading, courses, community, newsletter or other products.
If you are describing your own experience, describe the tool — what it shows you and how you use it — never what you made. Where a claim could be read either way, we will read it the way a reasonable customer would.
8. How you may not promote
- Bidding on "TapeRank", our domains or misspellings of either in paid search, or using them in ad copy or display URLs.
- Registering or using a domain, subdomain, social handle, app or page name containing "TapeRank" or a confusable variant.
- Presenting yourself as TapeRank, as our employee or agent, or operating anything a person could mistake for our official site, account or support channel.
- Unsolicited email, SMS or direct messages; posting into communities against their rules; or any activity that would be spam under the CAN-SPAM Act or equivalent law.
- Cookie stuffing, forced clicks, auto-redirects, iframes, toolbars, extensions, adware, or any method that sets the cookie without a deliberate click.
- Coupon, deal or voucher sites listing codes we did not give you for that purpose, or advertising discounts we do not offer.
- Sites or channels carrying unlawful, hateful, sexually explicit or infringing material.
- Promotion to anyone under 18, or in a jurisdiction where it would be unlawful.
9. Our name and brand
While you are an approved affiliate we grant you a personal, non-exclusive, non-transferable, revocable license to use the TapeRank name and logo solely to promote the Service, in the form we supply and without alteration. You acquire no rights in them. The license ends when your participation does, and you must then stop using them and remove your links.
10. Taxes
You are an independent contractor and responsible for your own taxes. We may require a valid IRS Form W-9 (US persons) or Form W-8BEN or W-8BEN-E (non-US persons) before paying you, and may withhold payment until we have one. Where the law requires it we will report amounts paid to you to the relevant tax authority.
11. Confidentiality
Figures you see in your affiliate dashboard about individual customers, and anything we tell you that is not public, are confidential. Do not publish them.
12. Term, suspension and changes
Either of us may end your participation at any time, for any reason, by notice. We may also suspend an account while we investigate. On termination for any reason other than your breach of section 6, 7 or 8, commissions already earned and past their hold are paid on the next normal cycle. On termination for a breach of those sections we may withhold unpaid commissions arising from the promotion that breached them. We may change these terms, the commission rate, the attribution window or the program itself; the effective date at the top changes when we do, and a change applies to sales made after it. Continuing to promote TapeRank after that date means you accept the change.
13. No partnership, and no warranty
Nothing here creates employment, agency, partnership or a joint venture. You have no authority to bind us or to make commitments on our behalf. The program is provided as is. We do not guarantee any level of traffic, conversion or earnings, and we do not warrant that tracking will be uninterrupted or error-free. To the fullest extent permitted by law, our total liability to you relating to the program will not exceed the commissions payable to you in the twelve months before the claim.
14. Indemnity
You will indemnify us against claims, losses, penalties and reasonable costs arising from how you promoted TapeRank, including any breach of sections 6, 7 or 8 and any regulatory action brought because of a statement you made.
15. Governing law
These terms are governed by the laws of the State of Idaho, United States, without regard to conflict-of-law rules, and the courts located in Idaho have exclusive jurisdiction. Contact us before starting a claim so that we can try to resolve it.
